Defense Forces of Pakistan Act, 2026

Pakistan’s National Assembly has introduced the Defense Forces of Pakistan Act, 2026 to establish the Defense Forces Headquarters, define the powers and functions of the Chief of the Defense Forces, and provide a legal framework for multidomain integration, operational cohesion, coordination and oversight of the Armed Forces.

The legislation provides for a unified Defense Forces Headquarters under the command and authority of the Chief of the Defense Forces, who will serve as the principal military advisor to the Prime Minister on national security, defense and matters relating to the Armed Forces.

What Changed Under the New Law?

Defense Forces Headquarters Established

The Act provides for the establishment of a Defense Forces Headquarters, which will serve as the headquarters of the Armed Forces.

The headquarters will:

• Function under the command and authority of the Chief of the Defense Forces
• Serve as the headquarters of the Armed Forces
• Support coordination and integration across the Armed Forces
• Operate under the authority of the Chief of the Defense Forces

Chief of Defense Forces Given Operational Command

Under the Act, the Chief of the Defense Forces will exercise operational command and control of the Armed Forces.

The Chief will also be responsible to the Federal Government for all matters relating to such command and control.

Principal Military Advisor to Prime Minister

The Chief of the Defense Forces will serve as the principal military advisor to the Prime Minister on:

• National security
• Defense
• Matters relating to the Armed Forces

Powers and Functions of the Chief of Defense Forces

The Act provides the Chief of the Defense Forces with powers and functions necessary for:

• Multidomain integration
• Operational cohesion
• Coordination
• Oversight of joint matters
• Oversight of tri-services matters
• Oversight of strategic matters involving the Armed Forces and national security of Pakistan

Authority Regarding Service Matters

The Chief of the Defense Forces may, subject to the laws relating to the Armed Forces:

• Retire personnel
• Release personnel
• Accept or reject resignations
• Discharge personnel from service
• Retain personnel in service
• Relax the age or service limit of retirement

These powers exclude persons appointed under Article 243 of the Constitution.

The Chief may also exercise other powers and perform other functions as the Federal Government may prescribe.

Rules and Regulations

The Act authorizes the Federal Government to make rules and regulations from time to time for carrying out the provisions of the law.

The Chief of the Defense Forces may also issue instructions and orders for implementing the provisions of the Act and the rules and regulations made under it.

Act to Override Inconsistent Laws

The Act provides that its provisions, along with rules, regulations, instructions, notifications and orders issued under it, will apply notwithstanding anything contrary contained in any other law or related instrument.

Where there is an inconsistency, the conflicting provisions will cease to have effect to the extent of that inconsistency.

The Act specifically states that the Pakistan Army Act, 1952, Pakistan Air Force Act, 1953, Pakistan Navy Ordinance, 1967, Cantonments Act, 1924, or other laws relating to members of the Armed Forces shall not be construed in a manner inconsistent with this Act.

Removal of Difficulties

If any difficulty arises in giving effect to the provisions of the Act or in removing inconsistency between this Act and any other law in force, the President may, by order, remove such difficulty.

Existing Rules and Actions Protected

The Act includes a savings provision for rules, regulations, instructions, notifications, orders and actions taken before the commencement of the Act.

Such measures will continue to be treated as valid provided they are not inconsistent with the new law.

Why Was the Law Introduced?

According to the Statement of Objects and Reasons, Pakistan’s response to Indian aggression was presented as demonstrating integrated tri-services jointness, real-time situational awareness, network-centric warfare capabilities and seamless multi-domain operations.

The statement also refers to simultaneous counter-terrorism operations in the western region and Operation Bunyan-ul-Marsoos, describing the coordination of different elements of national power.

The Bill therefore provides for a Defense Forces Headquarters under the command and authority of the Chief of the Defense Forces to strengthen integration and jointness across the Armed Forces.
