9 News HD: The Peshawar High Court (PHC) has sought the federal government’s response to petitions filed by Pakistan Tehreek-e-Insaf (PTI) against the imposition of emergency and governor’s rule in Khyber Pakhtunkhwa (KP).

A two-member bench, comprising Justice Ijaz Anwar and Justice Faheem Wali, heard the petitions filed by PTI Chairman Barrister Gohar Ali Khan and Advocate Salman Khan. The petitioners have asked the court to declare the emergency and governor’s rule unconstitutional and set aside the decisions.

During the hearing, the lawyers argued that the provincial government and assembly were still working and that there had been no breakdown of the constitutional system. They also said that Article 234 of the Constitution could be used only under specific conditions when a provincial government was unable to function.

The federal government had imposed emergency and governor’s rule in KP on October 11, 2026. It cited rising terrorism and concerns about the provincial government’s support for counterterrorism operations as reasons for the decision.

PTI has challenged these measures, arguing that they were imposed without proper legal grounds. The party wants the court to review the decision and declare it unconstitutional.

After hearing the arguments, the PHC issued a notice to the Attorney General’s Office and sought its response. The court has adjourned further proceedings until November 10.

The case is important because it concerns the powers of the federal government, the role of the provincial government and the constitutional status of emergency measures in KP. The court’s next hearing may bring further details about the government’s position and the legal arguments presented by both sides.
